Coltart says its it was Patrick Chinamasa not Jonathan Moyo who drafted and steered the draconian Public Order Security Act (POSA)


Former MDC secretary for Legal Affairs David Coltart has absolved ex-Minister Professor Jonathan Moyo on allegations that he was involved in the drafting and steering of the notorious Public Order Security Act.
In a tweet on Tiesday Coltart said, “As I recall it was Patrick Chinamasa who steered POSA through parliament with great support from the then speaker of parliament Emmerson Mnangagwa.”
Professor Moyo added, “And the Minister of Home Affairs was John Landa Nkomo.”
The issue began when Moyo invited Coltart and former Finance Minister Tendai Biti to respond to ZANU PF Patriots who had said, “Jonathan Moyo’s POSA is gone. Government last Friday gazetted the Maintenance of Peace and Order Bill to replace the POSA in line with its commitment to open up democratic space and align laws with the constitution as part of the reform agenda of the Second Republic.”
The notorious POSA was an unpopular Act of Parliament that was used by the President Robert Mugabe administration to ban opposition and civic society meetings . Morgan
It also gave power to police officers to determine whether then could clear a public gathering or not.
Before the 2008 elections the late MDC leader Morgan Tsvangirai and other opposition leaders were beaten up in Harare after alleged holding a rally that was not sanctioned under POSA.
The Act was currently inconsistent with the 2013 Constitution. Source – Byo24
