MDC-T CHAMISA, TO APPEAL IN Supreme Court appeal against the judgement by Justice Francis Bere that no-one has a claim over the MDC T name and symbol without a competent court resolution over the matter.
 
Recently Zimbabwe’s Justice Bere, ruled that no-one has a claim over the MDC T name and symbol without a competent court resolution over the matter.
 
Harare lawyer Advocate Thabani Mpofu was tasked to lodge an appeal over this by MDC T at the Supreme Court.
 
The MDC T argues that High Court judge Justice Francis Bere erred in making pronouncements on major issues not brought forward, which the appellants did not have the opportunity to submit in their defence.
 
It is argued by the MDC-T that the High Court Judge Justice Bere, misdirected seriously by finding the matter not urgent and also argued that the court the court came up with a wrong conclusion, and that the High Court erred in dismissing the case .
 
The is seeking an order setting aside the order of the High Court and for the case to be heard before a different judge at Bulawayo High Court.
 
My opinion, is that courts do not operate on favours and make judgemment according to law. Chamisa now faces a major challenge in that

If its Zanu pf, MDC, MDC T, PDP or any of the other 120 or so political parties who win, congratulations to them but let it be a wise decision.
 
Political maturity, unity of all people, Return of respect for the Rule of law, Electoral reform, removal of the military from the rural areas, demilitarisation of institutions such as Zec and depoliticisation of the judiciary, equality of all tribes, gender, religion or other, as anyone can lead the people of Zimbabwe is critical for the country to move forward.
 
It is not the numbers that matter, but the ability to interpret the law and follow the dictates of the law accordingly. Lovemore Madhuku has proved this for all Zimbabweans, by winning Khuphe’s case over MDC T leadership and loggo matters, easing Chombo’s bail conditions and other. We need gender equality and the removal of oppressive laws such as AIPPA, POSA in place. Zimbabweans have to wake up and realise that its not only popularity that will lead, but the constitution and law of the organisation and country, so numbers are not important in the final outcome. They may influence choices but not the law.
 
The fact that Madhuku is winning in case where we can rightly say that Lawyers,Tendai Biti, Welshman Ncube and Nelson Chamisa should have long spotted the troubles ahead and implemented measures to rectify it, yet did, not, speaks volumes about Lovemore Madhuku’s professional abilities. His NCA political party certainly have an asset out of his leadership on account of this, as its becoming clear that he is becoming the real game changer in Zimbabwe’s politics.
 
In a shocking revelation, by the ex Reserve Bank of Zimbabwe governor, Gideon Gono, to the brainwashed Zimbabwean electorate, he has proven that politicians are liars and can convince people that all is well or that they will address issues, knowing very well that the opposite is true.
 
Gideon Gono is now attempting to absolve himself from the economic decline and justify the printing of money by Mugabe, Zanu pf stalwart and securocrats regime, claiming that he knew it would result in hyperinflation but it had to be done because because the government was desperate to forestall a coup by angry, hungry soldiers in the army.

Chamisa recently promised rural airports, sphaghetti type roads, bullet trains, Ndebele king and to install WIFI at each rural homestead, claiming “Even goats will be able to have access to the mobile network,”.
 
The MDC T president is said to have gone on to state that “Even goats will be able to have access to the mobile network,” Mr Chamisa said at the rally. “Wherever one is, even if they are in their own house or at their small house, then they will be able to access mobile networks.”-wake up Zimbabwe!
 
Lest you forget, Chamisa , is presently fighting from a weak position with respect to his credibility after the numerous arguably ‘childish’ promises and in some ways, lies that he is amusing crowds with, case in point, Nelson Chamisa few days ago even claimed to supporters at Ruwangwe business centre in Nyanga North, that the opposition group had unearthed Zanu PF’s election rigging machinery, even stating, “I know there are soldiers, who have been sent to rural areas and they are not in uniform, but disguised as civilians to monitor your activities ahead of the polls.” NEWSFLASH, this is a false allegation on soldiers in civilian attire, remember we have continuously advised readers that early January, Mnangagwa, had dployed over 2000 soldiers across rural areas.
 
Chamisa’s lies were exposed earlier this year after the United States publicly distanced itself from claims by the MDC Alliance leader when he claimed that in arecent visit to the Us by him and Tendai Biti, the US President Donald Trump promised the MDC opposition party US$15 billion if they won the forthcoming harmonised 2018 elections.
 
Chamisa, later drew the family of the late Vice President Dr Joshua Nkomo, into his string of public lies after claiming that Dr Joshua Nkomo family had offered him the late Joshua Nkomo’s sceptre.
 
“I was so touched when I went to Dr Nkomo’s Matsheumhlophe house. I was going there to see the history of this nation. However, the family told me one thing, they said ever since the death of Dr Nkomo, I am the first national leader to visit the house, they even offered to give me Dr Nkomo’s traditional sceptre (intonga),” Mr Chamisa claimed. Dr Nkomo’s son, Mr Sibangilizwe, dismissed Mr Chamisa’sutterance, questioning “that a young man like Chamisa can speak such an abomination?”
 
Now we should advise the public that the government deployment of soldiers across rural areas, is not news. We have told the people about the military deployment of at least 2000 soldiers across rural areas, continuously since January 2018,….seriously? And Chamisa has only picked that out now,..really? Some of the claims and promises being made, are clearly ridiculous, indicative of political immaturity and will eventually cost the opposition in terms of votes,..wake up Zimbabwe!
 
With such a damaging run up to elctions, its atall order for him to place the appeal in the Supreme court as planned, because , remember Mnangagwa, Zanu pf stalwarts and securocrats are not losing any sleep over this because they expected this to happen, and its only going to expedite, yet another judgement by the courts against Chamisa, because they had it all well choreographed to work out this way. Chamisa is effectively destroying his own ‘unconstitutional rise to power’ by putting the final nail into the death of the once powerful MDC T opposition.
 
We all have to admit that if we uphold the Respect for the Rule of Law, and the judgement is based on credible evidence of breaches by the losing side, then we will have to live with the final ruling. If Chamisa is confident, I wonder why credible lawyers such as Tendai Biti and a Constitutional Lawyer Welshman Ncube, are absolutely silent over the matter. However as I have warned the people of Zimbabwe before, Chamisa’s fall, may not be abig issue to Tendai Biti, PDP, Welshman Ncube MDC Zanu pf as it will present opportunity for their party loggos to be used to register political party opposition and by default, place either of them depending on whose logo is used, at the helm of the MDC Alliance in the harmonised 2018 elections.
 
Courts do not work on popularity of individuals, number of followers or other favouritism, but simply interpret the law, and based upon the evidence presented, give a ‘fair judgement.
 
Its possible that Chamisa in hindsight realises that his unconstitutional rise to power, and swift recall of khuphe from parliament, may have been a mistake, because he now faces the prospect of him being recalled from parliament by Khuphe as the MDC T leader, on the grounds that he does not represent MDC T and she is the legitimate leader of MDC T based upon the prevailing circumstances.
 
Zimbabwe, before you waste time insulting people, open your eyes, accept the truth about the current issues. My point, is that if Khuphe recalls Chamisa from parliament and Zec does not registers him to register the MDC Alliance political party, it effectively means, that he would have losty his Kuwadzana MP seat which he gave up when he thought its a guaranteed run to Statehouse, lost the ability to represent the MDC Alliance as their political leader in elections, lost the MDC T party leadership, and overnight become a nobody.
 
Mnangagwa, Zanu pf stalwarts and securocrats are not complaining and this time they are not using violence but brains. Remmber, these are the guys who protected Mugabe for 37 years, destroyed the country in almost 40 years, were behind, gukurahundi, murambatsvina, Chiadzwa genocides, 2008 election violence, 2013 NIKUV , the Operation Restore legacy coup , removal of Mugabe and all other chaos in Zimbabwe. It is folly to assume that the same people would hand over power to Chamisa and the democratic opposition, six months later and give up their seats on the looting gravy train. Wake up Zimbabwe!
