‘Zimbabwe’s Women, Granted Their Right To Free Movement By Bulawayo High Court Judge’
Women in Zimbabwe will certainly be celebrating their right to free movement after Bulawayo High Court judge, Justice Nokuthula Moyo, ruled that under the Criminal Law (Codification and Reform) Act, loitering for the purposes of prostitution is no longer a crime as that law is now non existent
It therefore follows that the arrest and fining of women, by police, on charges of allegedly loitering for the purposes of prostitution,is illegal as , its a non-existent crime.
Originally, the now, non-existent crime of loitering for the purposes of prostitution, was provided for under section 4 of the Miscellaneous Causes Act but, was effectively, repealed in 2006, rendering, loitering for the purposes of prostitution, no longer a crime
The court argued that , there being no men to confirm having been approached by the women for the purposes of prostitution, any such arrests by the police are unconstitutional….Discusss! By Sibusiso Ngwenya
