Kenya’s Supreme court has overturned Mr Kenyatta’s re-election last month, after a panel of judges ordered a re-run of the vote within 60 days.
Kenya recently , in August held elections in which President Uhuru Kenyatta the son of Kenyatta, the founding father of the nation, won the election a second term with 54 percent of the votes but Kenya’s Supreme court has overturned Mr Kenyatta’s re-election last month, after a panel of judges ordered a re-run of the vote within 60 days.
The decision to cancel the vote result, the first of its kind in Kenya’s history, sets up a new race for the presidency between Mr Kenyatta and veteran opposition leader, Raila Odinga.
The Opposition Raila Odinga filed a petition in which a six-judge bench ruled 4-2 in favor of the petition filed by Odinga.
Raila Odinga had claimed that the electronic voting results were hacked into and manipulated in favor of President Uhuru Kenyatta who had won a second term with 54 percent of the Kenyan vote last month.
In an unprecedented situation of courts overturning an election result in Africa, Kenya’s Supreme court has effectively overturned last month’s Kenya presidential result , a first in Africa, a powerful message to the continent that it is possible to upset electoral rigging by African leaders .
The court has declared President Uhuru Kenyatta’s election victory as invalid because of noted irregularities in the election by the election board, which failed to conduct the Kenya presidential election in a manner consistent with the dictates of the Kenya national constitution.
Kenya’s supreme court has declared President Uhuru Kenyatta’s victory as null and void and ordered that a new vote must be held within the next 60 days in Kenya.
The Kenya election was mainly contested by Mr Odinga and Uhuru Kenyatta. The loser, Odinga contested the past three elections in Kenya and repeatedly lost each election.
Odinga however , always alleged at each election that the votes were rigged , and in the 2007 Kenya ballot, Odinga had lost. He went on to challenge the election victory by Kenyatta. The 2007 electoral poll led to unimaginable violence in which a total of 1,200 people were killed.
In the subsequent poll, in 2013, Kenya Supreme Court dismissed Odinga’s petition to the courts on the election victory by Kenyatta.
However in the 2017 Kenya ballot held last month, Odinga’s camp aimed at proving that the tallying and transmission of results was a flawed process, instead of focusing on how much vote rigging had occured.
In Zimbabwe, an African nation ruled by the despot Robert Mugabe for the last 37 years, there are frequently accusations of vote rigging by the despot, who has the Zimbabwe Electoral Commission chaired by Justice Rita Makarau , a woman he lovingly refers to as ‘my daughter’ and also a woman from Zvimba, MUgabe’s rural home.
The Minister of Justice is the Zanu pf Vice president Emmerson Mnangagwa, Mugabe’s personal aide during the war, who has constantly swung between Minister of state security and Justice minister for the last 37 years.
Mnangagwa has beneath him, a partisan judiciary manned by Zanu pf aligned judges, the airforce headed by a Zvimba man Bigboy Samson Chikerema, a cousin of Robert Mugabe from his mother’s side. Bigboy Samson Chikerema changed his name to Perrance Shiri after the liberation war.
The army is headed by General Chiwenga, who was accomplice to the horrendous gukurahundi genocide between 1983 and 1987 in which at least 20,000 Ndebeles from Matebeleland and Midlands, as head of 1Brigade then at Bulawayo’s Lewellin barracks, and head of the Bulawayo logistics centre from which all gukurahundi attacks by ‘Bigboy Samson Chikerema’s Fifth brigade were run from. Mugabe’s cousin ‘Bigboy Samson Chikerema was head of the brutal North Korean trained tribalist Fifth Brigade while Mnangagwa was in charge of all security including the brutal CIO as Minister of state security.
Zimbabweans are only heading for another fraudulent electoral victory by Mugabe’s Zanu pf in 2018. We have already seen evidence of this through the registrar general Tobaiwa Mudede declaring that only the latest plastic ID cards and not old metal ID cards will be accepted fro voting, a Zanu pf partisan judiciary Bigboy Samson Chikerema , Emmerson Mnangagwa and General Chiwenga all firmly in place and ready to violently defend Robert Mugabe’s fraudulent victory as always in 2018. To Mugabe’s advantage, there is nothing in our constitution to stop him from declaring an early election and that would be a great advantage as he can catch out an unprepared opposition.
The Kenyan experience is a huge eye opener for the Zimbabwean electorate and should be a learning curve for us all,… as always, I say No Reforms no elections!
Uhuru Kenyatta was the presidential sitting candidate for a few days since the announced victory but he is now only a Presidential hopeful. He was quick to announce that he disagrees with the court ruling but accepts it and will win again, alleging that the six judges involved had chosen to go against the will of the people of Kenya. He called for peace and emphasised that neighbours should live peacefully even if they are political opponents.
This is actually the first time ever in the history of the African continent that a judge or panel of judges have reversed a presidential victory invalid, null and void.
Opposition leader Raila Odinga, says members of the Election Commission the only body that is legally entitled to run an election in Kenya should resign and face prosecution and does not trust the same people blamed for the election chaos to be in charge of the rerun. If elections are not held within 60 days then the Speaker of the National House of Assembly takes over Presidency and elections are arranged afterwards. By Sibusiso Ngwenya
